These Terms of Use govern your access to and use of niftavio.com. By using this website, you agree to these Terms and the policies referenced below.
Please read these Terms carefully before using the Site. If you do not agree, please discontinue use of the Site.

You must be the age of majority in your state or have permission from a parent or legal guardian to use the Site.
Using the Site
We grant you a limited, revocable and non-transferable right to use the Site for lawful, personal and non-commercial purposes.
Information you provide through the Site must be accurate, current and complete. You are responsible for reviewing your contact, payment and delivery information before submitting an order.
You may not:
- Use the Site for an unlawful, fraudulent or deceptive purpose.
- Copy, reproduce, sell, distribute or commercially exploit Site content without written permission.
- Upload viruses, harmful code or material intended to disrupt the Site or another system.
- Scrape, crawl, data-mine or use automated tools to collect content or personal information.
- Bypass security measures, interfere with Site operation or gain unauthorized access.
- Impersonate another person, submit false information or violate another person’s legal rights.
We may restrict or terminate access when we reasonably believe these Terms, applicable law or Site security have been violated.
Site and Product Information
We make reasonable efforts to keep Site information accurate and current. However, descriptions, images, availability and other content may occasionally contain errors, inaccuracies or omissions.
We may correct errors, update information or modify the Site whenever reasonably necessary. We do not guarantee that the Site will always be available, uninterrupted, secure or error-free.
Product purchases, prices, payments, order acceptance, shipping, returns and refunds are governed by our Terms of Purchase and related policies.
Electrical Safety and Compatibility
Product specifications, plug types, voltage requirements and installation methods may vary by product and destination. Review the product page and available electrical options before placing an order.
You are responsible for selecting an electrical standard suitable for the country and location in which the product will be used. An adapter, converter or other compatible component may be required in some locations.
Hardwired lighting and other products requiring electrical installation should be installed by a licensed or otherwise qualified electrician in accordance with applicable local codes and product instructions.
Unless a product listing expressly states otherwise, electrical products should be used only in dry indoor locations and kept away from water, excessive moisture and unsuitable electrical sources.
Intellectual Property and User Content
Site content—including text, designs, graphics, logos, images, video, software and layout—is owned by or licensed to the Company and is protected by United States and international intellectual-property laws.
You may not use our trademarks, branding or protected content without prior written permission.
You are responsible for reviews, comments, images and other content you submit. You must not submit unlawful, misleading, defamatory, infringing, harmful or unauthorized material.
By submitting content, other than personal information governed by our Privacy Notice, you grant the Company a worldwide, royalty-free, non-exclusive, transferable and sublicensable license to use, reproduce, modify, publish, display and distribute that content in any media, subject to applicable law.
If you believe content on the Site infringes your copyright, contact us at service@niftavio.com with identification of the protected work, the disputed material, your contact information, a good-faith statement and confirmation that your notice is accurate and authorized.
Third-Party Services
The Site may include links to or services provided by payment processors, shipping carriers, social-media platforms and other third parties.
We do not control and are not responsible for third-party content, availability, security, products, services or privacy practices. Accessing a third-party service is at your discretion and may be subject to separate terms.
Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Site and its information, content, tools and services are provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied or statutory.
To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Site will be uninterrupted, secure, accurate, complete or free from harmful components.
Certain states do not permit the exclusion of particular warranties. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.
Limitation of Liability
To the fullest extent permitted by applicable law, the Company and its directors, employees, agents, licensors, suppliers and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data, goodwill or business opportunity arising from or relating to the Site.
These limitations apply regardless of whether a claim is based on contract, warranty, negligence, tort, strict liability or another legal theory.
To the extent permitted by law, any claim arising from or relating to the Site must be commenced within one year after it arises.
Some states do not allow certain liability limitations. These limitations therefore apply only to the maximum extent permitted by the law applicable to you.
Indemnification and Events Beyond Our Control
To the extent permitted by law, you agree to indemnify and hold harmless the Company and its employees, agents and service providers from third-party claims arising from your unlawful use of the Site, violation of these Terms, fraud, willful misconduct or infringement of another person’s rights.
We will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including severe weather, natural disasters, war, civil unrest, government action, customs restrictions, labor disputes, transportation interruptions, internet outages or supply-chain disruption.
To the extent permitted by applicable law, risk of loss and title for items shipped under a shipping contract pass to you when the items are delivered to the carrier. This does not override non-waivable consumer rights or protections expressly provided in our Shipping Policy or Return Policy.
Disputes and Governing Law
Before beginning formal proceedings, please contact service@niftavio.com with a description of the dispute and the resolution requested. The parties will attempt in good faith to resolve the matter informally.
Except where prohibited by law, unresolved disputes arising from the Site, these Terms or a purchase will be resolved through binding individual arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules.
The Federal Arbitration Act governs the interpretation and enforcement of the arbitration agreement. Either party may still bring an eligible individual claim in small-claims court or seek urgent injunctive relief where permitted.
To the fullest extent permitted by applicable law, you and the Company agree to bring claims only on an individual basis and waive the right to participate in a class, collective, consolidated or representative action and the right to a jury trial.
These Terms are governed by applicable federal laws of the United States. Where federal law does not control, the applicable law of the state having a legally sufficient relationship to the dispute will apply.
A dispute not subject to arbitration may be brought in a state or federal court having proper jurisdiction under applicable United States law.
Nothing in these Terms limits a mandatory federal or state consumer right that cannot lawfully be waived.
Changes and General Provisions
We may update these Terms to reflect changes to the Site, our business, applicable law, regulatory requirements or security practices. Revised Terms become effective when posted unless applicable law requires additional notice.
If any provision is found unenforceable, it will be modified or severed to the minimum extent necessary without affecting the remaining provisions.
Our failure to enforce a provision does not waive our right to enforce it later. You may not transfer these Terms without our written consent. We may transfer them to an affiliate, successor or third party as part of a business transfer, subject to applicable law.
These Terms and the policies incorporated into them constitute the entire agreement concerning your use of the Site. Provisions that by their nature should continue will survive termination.
